Employment Practices Liability (EPL)

Employment practices liability insurance may respond to certain employment-related claims or allegations — such as wrongful dismissal, discrimination, harassment, or retaliation — subject to policy definitions, exclusions, claims-made conditions, and reporting requirements. It is liability insurance for defined employment claims, not a fund that automatically pays Employment Standards Act termination pay, severance pay, unpaid wages, vacation pay, or benefits. It also does not replace human-resources advice, legal counsel on how to terminate, or Workplace Safety and Insurance Board coverage for workplace injury. Ontario employers operate under statutes such as the Employment Standards Act, 2000, the Human Rights Code, and OHSA workplace-harassment duties — those create employment and compliance obligations; insurance response still depends on the form. Ontario’s Employment Standards Act, 2000 can require termination pay and, where applicable, severance pay as employer obligations regardless of insurance. Depending on policy wording, EPL may respond to certain covered allegations arising from employment decisions — including defence costs or covered damages where applicable — but it does not automatically pay statutory termination pay, severance pay, unpaid wages, vacation pay, or benefits.
